Welcome to Top Hat Nannies. By using our website, registering as a client, or engaging our services, you agree to the following Terms & Conditions.
Our aim is to provide discreet, reliable, and exceptional childcare and household staffing solutions for families who value excellence, confidentiality, and trust.
1. Our Role
Top Hat Nannies acts solely as an introduction agency. We introduce childcare professionals and private household staff to families but do not employ the candidates. Once a candidate is placed, all contractual and legal responsibilities lie directly between the family (Client) and the Candidate.
2. Client Responsibilities

Clients are expected to provide accurate, complete, and up-to-date information regarding their household and staffing requirements.

Clients are responsible for issuing a proper employment contract to any Candidate they hire, including duties, remuneration, working hours, holiday entitlement, notice periods, and benefits, in accordance with UK employment law.

Clients must ensure salaries, taxes, National Insurance, and any other statutory contributions are paid as required.

Clients are responsible for providing a safe, professional, and respectful working environment.
3. Candidate Vetting
All Candidates introduced by Top Hat Nannies are carefully screened and verified, including:

DBS / criminal record checks

Professional references

Relevant qualifications and experience
While the Agency takes great care in this vetting process, the final responsibility for confirming a Candidate’s suitability rests with the Client.
4. Fees & Payments

Placement fees are payable once a Candidate introduced by the Agency is engaged.

Fees are non-refundable unless otherwise agreed in writing.

The Agency may offer a replacement Candidate at its discretion, provided all invoices have been paid in full.
5. Placement Fees & Trial Guarantee

8-Week Trial Period
All clients enjoy an 8-week trial period with their selected Nanny. Should the Candidate not meet your expectations during this period, the Agency will provide a full replacement at no additional cost, provided the Agency is notified within the 8-week trial period. -
The Agency may also offer additional replacement Candidates at its discretion, once all invoices have been settled in full.

For families seeking a long-term, premium service, Top Hat Nannies offers an exclusive membership option.

This service provides priority introductions and dedicated support for your household over an extended period.

Membership ensures that your family receives personalised, confidential, and priority access to our network of highly qualified childcare and household staff.

Details regarding membership duration, availability, and terms are provided privately upon request, reflecting the exclusivity of this service.
6. Confidentiality & Privacy

We handle all enquiries with the highest level of discretion and professionalism.

Both Clients and Candidates are required to treat all personal information shared during the placement process as strictly confidential.

Top Hat Nannies complies fully with UK GDPR and all relevant data protection legislation.
7. Liability

Top Hat Nannies is not liable for the actions, omissions, or conduct of any Candidate once placed.

We are not responsible for any loss, damage, injury, or claims arising from a Candidate’s employment, except in cases of negligence directly attributable to the Agency.

By engaging our services, the Client agrees to indemnify Top Hat Nannies against any claims arising from their employment relationship with the Candidate.
8. Governing Law
These Terms & Conditions are governed by the laws of England & Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales.
